In the US, trademark rights are created through use of the mark in commerce. Such rights are known as common law trademark rights. You can use the ™ symbol next to trademarks and the SM symbol next to service marks before they are registered. Registration is optional but creates several extremely important rights and remedies that do not exist with common law trademarks.

We do this by conducting a search of the physical records at the US Patent and Trademark Office (currently located in Crystal City, Virginia). The physical records are generally more reliable than the records available on the Internet. Nevertheless, it is worth checking on the Internet first by doing a web based search and a search at the US Patent and Trademark Office Website before retaining an attorney to proceed further.
