Advisory Notice Regarding Trademark Searching on the Internet

For many years now we have tracked trademark searching resources at the United States Patent and Trademarks Office (“USPTO”), both first hand and through associated firms.

 The Internet has helped those of us in the legal profession to conduct quick searches, and when appropriate, allows our clients to conduct preliminary searches.  However, as is well known, the resources on the Internet are not as complete as the resources that are available at the USPTO and it is therefore normally appropriate for an initial search and is not a complete database.  To be sure, the database that is available in the USPTO is the same as that available to the public at the USPTO, but is not the same as the database that is the available to the public on the Internet.  Furthermore, the search engine and methodology available to the examining attorneys and the public at the USPTO are far superior to those available what is available on the Internet
